Can Mamata-Vijayan-Stalin stop CAA?
With the Union government officially announcing the regulations of the Citizenship (Amendment) Act (CAA), the dispute regarding its enforcement in various states has intensified. States governed by parties opposed to the BJP, such as Bengal and Kerala have declared their intention not to execute the law.
Nevertheless, constitutional provisions stipulate that states are not empowered to decline the implementation of the CAA, as citizenship falls within the purview of the Union List, not the State List.
This is as outlined in Article 246 of the Constitution of India, which delineates the division of legislative powers between the Parliament and state legislatures.
